Victory at the 7th Circuit in New Albany DVD case!

Yesterday the 7th Circuit Court of Appeals upheld the right of towns and cities to regulate s*x businesses. Oral arguments for New Albany DVD, LLC vs. City of New Albany were made before the 7th Circuit 4 years ago. Anytime a court upholds the rights of a community to protect itself from the harmful nature of the s*x industry, we should celebrate the ruling. However, ROCK is disappointed that the decision requires the city of New Albany to provide more unnecessary evidence regarding the harms associated with s*x businesses. This requirement is inconsistent with prevailing U.S. Supreme Court rulings. The case will be remanded to a lower court where we believe New Albany can prevail in their efforts to protect the community from the documented negative effects of the s*x industry.
