Victory! The 11th Circuit upholds local community standards in internet obscenity cases!
The 11th Circuit has upheld the convictions of Paul Little, a.k.a. Max Hardcore, producer of so-called adult pornography. The court has also ruled in favor of “local community standards” in internet obscenity cases rather than allowing pornographers apply a generic national standard.
According to news reports, the defendant, represented by H. Louis Sirkin, argued for a national standard to be applied to Internet porn when defining what is obscene. You might recognize Mr. Sirkin’s name as the attorney who most recently defended the manager of Theatair X.
ROCK President Bryan Wickens stated: “This is a huge win for decency! ROCK is thrilled that the court correctly applied the local community standard instead of where movies are produced or try to come up with some kind of ‘national standard’ that would not reflect the local mindset. Imagine having Hollywood standards applied to a potential Theatair X case instead of applying southern Indiana community standards when defining obscenity. This decision is encouraging because it proves when citizens get off the sidelines and stand up for what is right, positive change will happen and our future generations of children and families will benefit from it.”
